Secondary Classification and Reclassification

Following the introduction of the secondary classification scheme, on an initial trial basis, we now propose to make some amendments to the procedure in the light of that experience. The secondary process cannot be purely automatic where the work was first classified on video before July 1st 1994 (when the 12 category was introduced). The question may then arise as to whether the original classification is still appropriate. However,reclassification will not be considered (other than in the most extreme cases which will make themselves known in the normal course of events) for works originally classified after 1st July 1994. Works classified prior to that date might be appropriate for reclassification.

The BBFC has formulated a set of guidelines that ensure fair and consistent treatment of the works:

Identical versions of works must be passed at the same category - that is , if the ratio, soundtrack and length are identical, with no material added or taken away . If a technical comparison shows that the tapes are in all respects (other than logo or similar ) identical, they must have the same category.

Works passed after 1/7/1994 should be given the same category whether they are identical or not. It may be possible in some circumstances to pass a different version at a different category if the company has ensured that all the previously classified versions have been removed from distribution but these cases will always be referred for a senior management decision.

Non-identical versions of works passed before 1/7/1994 - versions that are dubbed, subtitled, different in ratio, different length - should generally be passed at the same category unless the old category is no longer reasonable or defensible. Any proposed reclassification under this test, except for pre -1994 15s being reduced to 12, must be referred for a senior management decision.

The company will be informed immediately of our intention to examine the work with the expectation of reclassification. The fee charged will be the same as for secondary classification i.e., it will not be increased.
